Please read these Terms of Service ("Terms") carefully before using the Training Endurance website and mobile application (the "Service") operated by Charges LLC ("Company," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Description of Service

Training Endurance is an adaptive training planning platform that provides:

  • Personalized training plans for endurance sports
  • Integration with fitness devices and platforms (Garmin, Polar, Suunto, Strava)
  • Training analytics and progress tracking
  • Workout synchronization with smartwatches

2. Account Registration

2.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information as needed
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account

2.2 Account Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

3. Subscription and Payments

3.1 Free and Paid Features

The Service offers both free and paid subscription plans. Free features may be limited in functionality. Premium features require an active subscription.

3.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly or annually)
  • Prices are listed in USD and may vary by region
  • You authorize us to charge your payment method for all fees incurred

3.3 Cancellation and Refunds

  • You may cancel your subscription at any time through account settings
  • Cancellation takes effect at the end of the current billing period
  • Refunds are provided in accordance with applicable laws and our refund policy
  • For subscriptions through App Store or Google Play, their refund policies apply

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Share your account credentials with others
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble the Service
  • Remove any copyright or proprietary notices
  • Use the Service to transmit harmful content or malware

5. Health and Safety Disclaimer

IMPORTANT:

  • The Service provides training recommendations for informational purposes only and is not a substitute for professional medical advice.
  • Consult a healthcare provider before starting any exercise program, especially if you have health conditions or concerns.
  • You are solely responsible for your health and safety during training.
  • Stop exercising immediately if you experience pain, dizziness, or other warning signs.
  • The accuracy of data from connected devices depends on the devices themselves.

6. Intellectual Property

6.1 Our Content

The Service and its original content, features, and functionality are owned by Charges LLC and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Your Content

You retain ownership of any content you submit to the Service (training data, feedback, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it to provide the Service.

7. Third-Party Services

The Service integrates with third-party platforms and devices. Your use of these integrations is subject to their respective terms and privacy policies:

  • Garmin Connect
  • Polar Flow
  • Suunto
  • Strava
  • Apple Health / Google Fit

We are not responsible for the availability, accuracy, or policies of third-party services.

Google API Services

Our use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF CONTENT
  • UNINTERRUPTED OR ERROR-FREE OPERATION

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARGES LLC SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Personal injury or property damage related to your use of the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of the Service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Charges LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

  • Your right to use the Service will cease immediately
  • You may request export of your data before termination takes effect
  • We may delete your data in accordance with our Privacy Policy

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Michigan.

14. Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us. If we cannot resolve the dispute within 30 days, either party may pursue formal proceedings.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
